ran out of gas put gas in but wont turn over
It's extremely unlikely that running out of gas would coincide with the hybrid battery's charge being too low to start the engine (bordering on impossibly unlikely). When the engine won't run (in your case, due to running out of gas) the computers won't let the battery's charge drop to the point that it can no longer start the engine -- it will shut-off the car first.
Perhaps you didn't actually run out of gas, and your problem lies elsewhere. (You might have been very low on gas, and assumed that was the problem.)
Get the codes read from the computer (some auto parts shops will do that for free) and see where they point you...
Edit: The other answer you've received so far is typical nonsense from a hybrid basher that's done no research. Let me count the ways...
1) "the bigger battery is rumored to be worth as much as $10,000" Are you kidding me? $10,000 will buy THREE batteries, INSTALLED, with change left over.
2) "toyota cheats by using low rolling resistance tires that blow out as early as 10k" Low rolling resistance tires definitely isn't cheating; it's the direction that tire and car manufacturers are heading for all vehicles. And I'd like to see some proof that these tires blow out at 10k, please. If properly maintained, you'll get at least double that, and probably triple that. Yes, you can still get much more mileage from a high-quality replacement tire; but that's typical of most cars -- manufacturers generally don't put high mileage tires on new cars. (And don't believe everything you read on the consumeraffairs.com web site; it's just a "gripe site" run by lawyers that are fishing for clients...don't let the name fool you, it's not run by Consumer Reports.)
3) "dust to dust did a study, results show that a prius is significantly more harmfull to the environment than even a hummer" That "study" was done by CNW Marketing "Research," and it is called "dust to dust." And I put "study" and "Research" in quotes, because it has been thoroughly debunked as being unscientific garbage, with bizarre assumptions pulled out of someone's ... well, I was going to use a synonym for donkey. For example: The Prius is expected to have a lifetime of about 109,000 miles and 11 years, and the Hummer about 379,000 miles and 35 years. Anyone that's followed the legacy of Toyota and the legacy of GM knows that those numbers would be far more believable if they were reversed!
